1. Who We Are

Floppy Recovery Ireland is a data recovery service based in Ireland. We operate at floppyrescue.com. When you contact us or submit a recovery order, we act as the data controller for your personal information and as a data processor for any data recovered from your disks.

2. What Data We Collect

We collect only the personal data necessary to process your enquiry or order:

  • Name and email address (required for all orders and enquiries)
  • Phone number (optional, provided by you)
  • Postal address (if you request return postage of physical media)
  • Details of the media you send us and the type of data it contains (as provided by you)
  • The content of the media you send, to the minimum extent necessary to recover and deliver your files

We do not collect payment card details directly. Payments are processed through a third-party invoicing system under their own privacy terms.

3. Legal Basis for Processing

We process your personal data on the following legal bases under the GDPR:

  • Contract performance (Article 6(1)(b)) -- processing your name, email, and order details to fulfil a recovery order you have placed.
  • Legitimate interests (Article 6(1)(f)) -- responding to enquiries, maintaining records of orders for accounting purposes.
  • Consent (Article 6(1)(a)) -- where you have explicitly ticked a consent checkbox on our contact form. You may withdraw consent at any time by emailing us.

4. How We Use Your Data

We use your personal data solely to:

  • Process and fulfil your recovery order
  • Communicate with you about the status of your order
  • Respond to your enquiries
  • Issue invoices and maintain financial records as required by Irish law

We do not use your data for marketing, profiling, or automated decision-making. We do not sell or share your personal data with third parties except as described in Section 5.

5. Data Sharing

We do not share your personal data with third parties except:

  • Postal and courier services -- to return your physical media, we share only the delivery address with the postal operator.
  • Invoicing software -- your name and email may be held by our invoicing platform to generate and deliver your invoice. This provider is located within the EU.
  • Legal obligation -- we may disclose data if required to do so by law or a court order.

The data recovered from your disks is never shared with any third party.

6. Data Storage and Security

All media is processed within Ireland. Recovered files are stored on an encrypted local drive and not uploaded to cloud services without your explicit consent. We use encrypted download links to deliver your files. We apply reasonable technical and organisational measures to protect your data against unauthorised access, loss, or destruction.

7. Retention

Recovered data is deleted from our systems within 30 days of delivery unless you request an extended hold. Contact details and order records are retained for 7 years for accounting and legal compliance purposes, then securely deleted. You may request earlier deletion of your personal contact data by emailing us; we will comply unless retention is required by law.

8. Your Rights

Under the GDPR, you have the right to:

  • Access the personal data we hold about you
  • Rectify inaccurate personal data
  • Request erasure of your personal data (subject to legal retention requirements)
  • Restrict or object to processing
  • Data portability (receive your data in a machine-readable format)
  • Withdraw consent at any time where processing is based on consent

If you are not satisfied with our response, you have the right to lodge a complaint with the Data Protection Commission (Ireland): dataprotection.ie.

9. Cookies

This website does not use tracking cookies, analytics cookies, or advertising cookies. We do not use Google Analytics or any third-party analytics service. No cookie consent banner is required.

10. Changes to This Policy

We may update this policy from time to time. The "last updated" date at the top of this page will reflect any changes. We will not retroactively change how we handle data already collected without notifying you.
